Andrew M. Gilstein is a Partner with Pannone Devereaux & O’Gara LLC and a highly experienced attorney who has been practicing law in Rhode Island for nearly five decades. Prior to joining PDO, Attorney Gilstein was a founding partner of Gilstein, Kinder & Levin, LLP, where he represented individuals, families, businesses and nonprofit organizations in a broad range of legal matters. His practice focuses on business and corporate law, commercial and residential real estate, estate planning and probate, and tax matters.

Attorney Gilstein advises business owners and organizations on matters involving business formations, partnerships and limited liability companies, commercial transactions, contracts and leases and employment contracts. His real estate practice includes commercial and estate transactions, title matters, real estate and title litigation. He also counsels individuals and families on estate planning, revocable trusts and probate administration and has represented clients in state and federal tax matters.

Throughout his career, Attorney Gilstein has successfully handled significant and complex tax matters. He litigated DeBlois v. Clark, a landmark Rhode Island tax residency case decided by the Rhode Island Supreme Court involving the taxation of individuals who establish their primary residence outside Rhode Island. He also successfully challenged an Internal Revenue Service audit determination involving the capital gains treatment of inventors under Section 1235 of the Internal Revenue Code.

In addition, Attorney Gilstein provides counsel to nonprofit organizations, including religious organizations and social service agencies. He has lectured on estate planning, revocable trusts, probate avoidance and Rhode Island estate tax matters.

A lifelong Rhode Islander, Attorney Gilstein earned his J.D. from Albany Law School of Union University and his B.A. in Political Science, with distinction, from the University of Rhode Island. He is admitted to practice in Rhode Island, the U.S. District Court for the District of Rhode Island and the U.S. Tax Court.

Attorney Gilstein is a member of the Rhode Island Bar Association and American Bar Association. He is also a member and former President and Board member of the Friendship Lodge of Touro Fraternal Association and a member of the Rhode Island Jewish Cemetery Association.
